§1 Scope of the General Terms and Conditions & Treatment Contract1a.) The General Terms and Conditions regulate the business relationship between the alternative practitioner and the patient as a treatment contract within the meaning of §§ 611ff BGB, unless otherwise agreed in writing between the contracting parties.1b.) The treatment contract is concluded when the patient accepts the general offer of the alternative practitioner to practice medicine towards anyone by implied action and turns to the alternative practitioner for the purpose of advice, diagnosis or therapy.1c.) However, the alternative practitioner is entitled to refuse a treatment contract without stating reasons; in particular if a necessary relationship of trust cannot be expected, if the complaints are those which the alternative practitioner cannot or may not treat due to his specialization or for legal reasons, or which could cause him to have a conflict of conscience. In this case, the alternative practitioner's claim to remuneration for services provided up to the time of rejection, including advice, remains intact.1d) Alternative practitioners often use methods that are not recognized by conventional medicine, cannot be generally explained, and do not correspond to the current state of science. These methods cannot generally be explained in terms of causality or functionality, and are therefore not targeted. A subjectively expected success cannot be promised or guaranteed. If the patient rejects the use of such methods and wants to be advised, diagnosed, or treated exclusively using scientifically recognized methods, he or she must declare this to the alternative practitioner in writing before treatment begins.§2 Termination of the treatment contract2a) The treatment contract can be terminated by either party at any time without notice.2b) Termination by the alternative practitioner at an inopportune time is only permissible, however, if there is an important reason for doing so. An important reason exists in particular if the patient does not provide the necessary anamnesis or diagnostic information, or provides it incorrectly or intentionally incompletely, if the alternative practitioner cannot or may not treat the patient due to a specialization or for legal reasons, or if there are reasons that could cause him to have a conflict of conscience. Any claims to fees already incurred by the alternative practitioner at the time of termination remain unaffected by the termination.


§3 Patient participation

3a) The patient is not obliged to actively participate. However, the patient must follow the agreed behavioral instructions, otherwise no treatment success can be expected. The patient has the opportunity to actively participate in the therapy planning at any time in order to create possible treatment alternatives. The resulting treatment plan must be followed. However, the alternative practitioner is entitled to terminate the treatment if the necessary relationship of trust no longer appears to exist, in particular if the patient denies the content of the consultation, provides inaccurate or incomplete information on the anamnesis and diagnosis, or thwarts therapy measures.§4 Remuneration of the alternative practitioner

4a) The alternative practitioner is entitled to a fee for his services, which is based on the GebüH. (Example: cost breakdowns of the current service catalog). Making an appointment at the Rückenwohl naturopathic practice is a fee-based service for which payment is required.


4b) Private health insurance or supplementary insurance do not always reimburse the full amount of the invoice.4c) The fees must always be paid in cash or by bank transfer after each treatment in the practice. The invoice is sent to the patient by email.

4d) Cancellation fee: In my practice I only work on appointments, which means there are no free consultation hours. Therefore, an individual time slot is scheduled for each patient without waiting room time. It is therefore not possible to move the next patient forward if an appointment is cancelled. I therefore ask for your help in rescheduling or cancelling appointments at least 24 hours in advance by phone (mailbox) or email. Appointments for Mondays must be cancelled on Saturdays. Appointments that are not kept or cancelled at short notice (less than 24 hours in advance) will be charged in full.

4g) For voucher holders, e.g. with a voucher number from a voucher portal, agreed appointments must be kept, otherwise the entitlement to the service expires. Appointments can also be rescheduled up to 24 hours in advance.§5 Appointments5a) Paid appointment: Making an appointment at the Rückenwohl naturopathic practice is a paid service that requires payment. If the patient/customer has a voucher number, they are obliged to state this in advance when making the appointment, otherwise the treatment must be paid for in cash/EC card in the practice.5b) Cancelling an appointment: In my practice I only work to order, i.e. there are no free consultation hours. Therefore, an individual time period with no waiting room time is planned for the patient. Accordingly, it is not possible to give the next patient priority if an appointment is cancelled. I therefore ask for your help in rescheduling or cancelling appointments at least 24 hours in advance by telephone (mailbox) or email. Appointments for Mondays must be cancelled on Saturdays. Appointments that are missed or cancelled at short notice (less than 24 hours in advance) will be charged in full.5c) Cancellation by the practice: In the event that the practice has to cancel and/or postpone appointments, patients undertake to provide a telephone number, e.g. mobile, at the time of making the appointment, where they can be reached in an emergency. The next possible alternative appointment will be offered.5d) Punctuality & delays: My practice is a pure appointment practice with no waiting room. Please be punctual for the agreed appointment, but not overly punctual. If I am still in treatment, you may have to wait until I can pick you up.If you are delayed by more than 15 minutes, the treatment appointment can no longer take place on time. In this case, a cancellation fee will also be due at my discretion. This can be offset pro rata against a new treatment appointment by arrangement. (see §4e)5e) Accompaniment: If possible, come to your appointment unaccompanied. In order to comply with data protection regulations, the presence of accompanying persons during treatment is not permitted. An exception is the presence of a parent or legal guardian for underage patients. There is no waiting area for accompanying persons in the practice.§6 Invoicing6a) The patient automatically receives an invoice by email after each appointment.§7 Reimbursement of fees by third parties7a) If the patient is entitled to reimbursement or partial reimbursement of the fee from third parties, this does not affect the alternative practitioner's fee claim in accordance with § 6. The alternative practitioner's fee is billed exclusively to the patient. There is no direct billing with a third party liable for reimbursement. The alternative practitioner also does not defer payment of the fee or parts of the fee in anticipation of possible reimbursement by third parties.7b) If the alternative practitioner provides the patient with information about the reimbursement practices of third parties, this is non-binding. In particular, the usual reimbursement rates do not count as agreed fees within the meaning of § 6 paragraph 2. The scope of the alternative practitioner's service is not limited to reimbursable services.

7c) All information and certificates required in connection with the reimbursement of the alternative practitioner's fee by third parties will be provided to the patient upon request. These services are subject to a fee. Information will not be provided to third parties.


§8 Group courses


Pre-registration for group courses is done via the online form. If there are free places available, you will receive an invoice by email after successful pre-registration. Your place is only secured once payment has been received. Please note that missed course units can only be made up within the validity period in the current calendar year. The course can start at any time, provided there are free places available. Please note that no courses take place during school holidays.

§9 DisagreementsDisagreements arising from the treatment contract and the general terms and conditions should be settled amicably. It is advisable to initially present objections, differing opinions or complaints verbally and, if necessary, in writing.§10 Severability ClauseIf individual provisions of the treatment contract or general terms and conditions are or become invalid or void, this does not affect the effectiveness of the treatment contract as a whole. The invalid or void provision is to be replaced by a provision that comes closest to the purpose of the contract and the will of the parties.
